Mineral Resource Act - Policy Intentions (Part 4)

Overview
The Northwest Territories (NWT) Mineral Resources Act (MRA) and its regulations will be the first-ever legislation governing mineral resources fully drafted in the NWT. The Government of the Northwest Territories (GNWT) is currently developing the regulations.
Residents are invited to consider the policy intentions that have been drafted for the MRA regulations and provide feedback for consideration by GNWT and Indigenous Government and Organization representatives, who are working to develop the regulations under the NWT’s legislation co-development process. This engagement is part 4 of a series of feedback opportunities for public feedback on policy intentions. These policy intentions focus on the proposed Mineral Rights Review Board, and transition of existing mineral interests.

To make it easier to organize feedback about specific regulations, an MRA Technical Feedback Table has been provided.
Background
Development of new Mineral Resources Act and its regulations has been ongoing since 2017. Engagement with the public has occurred in several stages including:
- 2017 – December: The public was invited to provide input into the development of the new Mineral Resources Act.
- 2022 – July: Public engagement on the subject of how royalties should be collected from Mining Projects.
- 2022 – Sept: A targeted Engagement opportunity for identified stakeholders.
- 2022 – November: Public Engagement on Policy Intentions that will inform the drafting of NWT MRA Regulations.
- 2023 – January: Before formal drafting began, NWT residents were provided an opportunity to consider and respond to MRA policy intentions by providing specific input and presentations to the IGC.
Next Steps
Feedback will be considered by the Intergovernmental Council (IGC) and Technical Working Group. Once fully drafted and agreed upon by the IGC, Section 35 consultation will take place on the proposed regulations. A (statutory) final public posting of the regulations will occur before the process is concluded and the NWT Mineral Resources Act is brought into force.
