The Government of the Northwest Territories has released a What We Heard Report based on the feedback received on the proposed changes to the Student Records Regulations.
The proposed changes to the regulations are intended to increase communication between the Minister and education bodies by establishing mechanisms for the exchange of information between education bodies and the Department of Education, Culture and Employment.
The proposed mechanisms would:
Permit the Minister to access student records for the purposes of evaluating school programs and monitoring student progress.
Permit school staff to disclose information in a student record to an education body or to ECE.
The Department of Education, Culture and Employment is also in the process of implementing a new Northwest Territories adapted curriculum based on the British Columbia curriculum and large-scale student assessments. The transition from Alberta to British Columbia curriculum necessitated updates to the regulations to remove specific references to Alberta, generalize the terminology and update the information contained in the student record.
These proposed updates are in part due to feedback from the Office of the Auditor General of Canada, which identified areas of improvement for the GNWT to collect and use data to monitor the education system, identify and address gaps, and ensure the system is working toward improving student outcomes. The proposed updates to the Student Records Regulations allow the GNWT to access this information provided by education bodies for internal monitoring purposes, while ensuring personal privacy is protected. Improved access to data will help the GNWT evaluate and monitor student progress and inform decisions to improve student outcomes.

During the 19th Legislative Assembly, Bill 81: An Act to Amend the Education Act, No. 2 (Bill 81) was passed. Several regulations must be amended before Bill 81 comes into force, including the Student Records Regulations.
The Department of Education, Culture and Employment engaged with education bodies and the Northwest Territories Teachers’ Association (NWTTA) on the proposed changes during the 2023-2024 school year. Education bodies and the NWTTA were engaged directly during the second round of engagement.
Next Steps
Results from the engagement have been summarized in a What We Heard Report. Now, the GNWT will work towards finalizing the proposed regulations, which will come into force soon, along with related sections of Bill 81.
